IndieSpectrum Radio & Virtual Music Network: Broadcast License Agreement (Internet)

1) Copyright Ownership
I, the undersigned artist, hereby warrant (and have verified) that I am the sole copyright owner for each of my musical composition(s) and sound recording(s) (hereafter referred to collectively as “Works”) submitted to IndieSpectrum Radio and Virtual Music Network (hereafter collectively referred to as the Owners) and that I have the full legal authority to grant a license to publicly perform and broadcast said Works. If the musical composition is a public-domain work, I affirm that I own 100% of the copyright on the arrangement of said musical composition.
1a)Human Authorship and Generative Artificial Intelligence

I represent and warrant that each submitted Work is fundamentally the product of human creative authorship and human creative direction.

I affirm that generative artificial intelligence was not used to create or generate any substantive lyrics, melody, harmony, musical composition, lead or background vocals, instrumental performance, backing track, musical arrangement, or other expressive musical or audio content contained in the submitted Work.

This restriction includes generative-AI-created material that has subsequently been edited, remixed, rearranged, overdubbed, mastered, or combined with human-created vocals, instrumentation, lyrics, or production.

The use of standard human-directed recording and production tools is permitted. Examples may include traditional virtual instruments, MIDI sequencing, drum machines, licensed sample libraries, equalization, compression, pitch correction, noise reduction, audio restoration, mixing, mastering, and similar production processes, provided those tools do not generate or replace substantive musical, lyrical, vocal, or instrumental content.

I agree to disclose truthfully any use of generative artificial intelligence associated with a submitted Work. IndieSpectrum Radio and Virtual Music Network may request reasonable information concerning the authorship, performance, recording, or production of a submitted Work when necessary to determine its eligibility.

I understand that IndieSpectrum Radio and Virtual Music Network may reject, remove, or discontinue use of any Work that violates this policy or whose eligibility cannot reasonably be verified.

If I knowingly submit prohibited AI-generated material or materially misrepresent how a Work was created, IndieSpectrum Radio and Virtual Music Network may reject or remove the Work and may suspend or permanently revoke my future submission privileges.

2) Grant of License
As the sole copyright owner for said Works, I give indiespectrum.com and vmnetwork.org my full permission to publicly perform and broadcast these Works over the Internet. By agreeing to this statement and uploading my music, I grant the Owners a license to publicly perform and broadcast these Works, royalty-free, in exchange for the opportunity to have my music heard by listeners of IndieSpectrum Radio and Virtual Music Network. I understand that I retain all rights, title, and interest to my Works including, without limitation, all copyrights. I understand that signing this agreement does not obligate the Owners to broadcast said Works.

3) Representation
As the copyright owner of the Works, I declare that in regard to licensing my Works to the Owners, I will represent myself. I waive representation by SoundExchange (for the RIAA, AFTRA, and AFM), BMI, ASCAP, and SESAC only as it relates to the inclusion of the Works in the broadcast of the Owners.

4) Opt-Out Option
I understand that, at my written request, I may have the Works removed from the Owners’ broadcast at any time. I will allow up to 30 days for the Works to be removed, though I understand the Works may be removed immediately upon notice.

5) Termination on Transfer of Ownership
If at any time, ownership of IndieSpectrum Radio and/or Virtual Music Network is transferred or otherwise conveyed, I understand this contract is null and void and must be renegotiated between myself and the new owner(s).

6) Term
This license agreement is valid from the date of signature until two years thereafter, unless earlier terminated pursuant to Section 4 or 5. Thereafter, the term will automatically renew every two years unless Section 4 or 5 is enacted. I understand that either I, or the Owners, may terminate or update this agreement at any time with 30 days’ notice.

Signature and Consent
By checking the “I agree” box and submitting, I affirm that I have read and agree to this Broadcast License Agreement and I sign electronically with my IP address and the information I submit. I understand this constitutes my electronic signature.
